A near-total federal ban on intoxicating hemp-based THC products is scheduled to take effect on December 11, 2026

The Federal Timeline and Rules

New Deadline: President Donald Trump signed a bill in September 2026 that delayed the restriction on naturally derived hemp THC products from November 12 to December 11, 2026.

Synthetic Ban: Fully synthetic or lab-converted cannabinoids (such as certain manufactured compounds not naturally made by the plant) do not get the full extension and face prohibition starting November 12, 2026.

The New Limit: The upcoming rules impose a strict standard capping finished hemp products at 0.4 milligrams of total THC per container.

Impact:

Industry experts estimate this cap will render roughly 95% of currently sold hemp-derived cannabinoid products (like common THC gummies, beverages, and full-spectrum oils) federally unlawful by reclassifying them as marijuana.
